Our position

Oton Technology respects copyright and expects the same in return. We publish original reporting alongside material used under fair dealing and fair use principles, such as brief quotation for the purpose of news reporting and commentary. If you believe material published here infringes your copyright, tell us and we will deal with it promptly.

Sending a notice

Send copyright complaints through the contact page. To be actionable, a notice should include the following.

  • Identification of the copyrighted work you say has been infringed. Where several works are involved, a representative list is acceptable.
  • Identification of the material on this site that you say is infringing, specific enough for us to locate it. A direct URL and a description of the passage or image is the practical minimum.
  • Your contact details, including an address and an email address at which you can be reached.
  • A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law.
  • A statement that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.
  • Your physical or electronic signature.

An incomplete notice may not be actionable, and we may come back to you for the missing parts rather than acting on it as sent.

What happens next

Valid notices are acted on promptly. Depending on the circumstances that may mean removing the material, replacing an image with a licensed alternative, adding attribution that was missing, or restricting access while the matter is examined. We will let you know what action was taken.

Counter notices

If material you supplied or authored was removed and you believe that removal was mistaken or the result of misidentification, you may send a counter notice identifying the material and its former location, together with a statement under penalty of perjury that you believe in good faith it was removed by mistake, and your contact details and consent to jurisdiction as applicable. Where the law provides for restoration after a counter notice, we will follow that process.

Misuse

Copyright process exists to protect rights holders, not to suppress reporting. Notices sent to remove accurate journalism, to conceal a public document, or to pressure the removal of legitimate criticism will be treated as what they are. Knowingly making a material misrepresentation in a takedown notice carries liability in several jurisdictions.
